German commercial law requires many companies to have their annual financial reports reviewed annually. This affects in particular corporations (except small GmbH’s) and private foundations. However, an annual audit can also be carried out voluntarily - that is, without any legal obligation.
The organs of a company have to prepare annual reports. This shows the business performance in the past period in a condensed form. German commercial law requires many companies to have their annual financial reports reviewed annually. This affects in particular corporations (except small GmbH’s) and private foundations. However, an annual audit can also be carried out voluntarily - that is, without any legal obligation.
The organs of a company have to prepare annual reports. This shows the business performance in the past period in a condensed form. It is the task of the auditor to check the bookkeeping and the accounting in terms of legal compliance. The result of the audit in the form of the auditor's report, therefore, tells nothing about the company's economic situation, but rather, confirms that the economic situation presented in the annual financial statements conveys a picture that corresponds to reality. The detection of embezzlement or other prohibited actions by the organs of the audited company is fundamentally not included. However, should an examination reveal such facts, there is of course an obligation to report. It should also be noted that the activity of the auditor has no connection with tax audits by the tax authorities.
The annual audit by the auditor thus serves the so-called "stakeholders". That is, all those involved in the company in some form (of course, the owners, of course, who receive reports on the use of their capital with the annual financial report; an audited annual financial statement is also important for banks).
